Foreign nationals cannot claim right to reside and settle in India: DHC

The Delhi High Court (DHC), while dealing with a Habeas Corpus writ petition calling in for the release of a Bangladeshi citizen, languishing in Detention Centre, has held that, a foreign national cannot claim to be having a right to reside or settle down in India in terms of Art. 19(1)(e) of the Constitution, the fundamental rights available to any such foreigner is limited only to right to life and liberty under Art. 21 of the Constitution. The DHC noting that the Bangladeshi citizen was found to be travelling on the basis of a forged Indian passport, his detention cannot be said to be illegal.
